Abstract
The emergence of PMSCs as one of international security actor is not a new
phenomenom. PMSC is a private company which offering several services such as
security, Military training, strategic analysis, and other kind of defense supports.
Increase of PMSC’s number including its involment in armed conflicts. Tend to
caused negative impacts. This fact became the starting point of international debates
on the existence of PMSCs, along with its rights and obligations according to
international lawa, particularly IHL. Several countries had tried to formulate
domestiregulations are not sufficient enough to regulate PMSCs because this actor
has a broad operational coverege and flexibility.
In Addition, the Swiss PDFA efforts in formulating the Montreux Document
use two types of instrument interactions. The first instrument in the instrument of
cooperation, which commited through a partnership of Swiss PDFA with the ICRC.
While the second instrument, is the instrument of multilateral diplomacy. This
research is a qualitative research were a primary and a secondary data. Methods of
primary data collections was conducted through an interview via e-mail, while the
secondary data was obtained thoruoghbooks. Journals, and other relevant sources.
