Abstract:
Election of Governor and Deputy Governor by Law Number 32 year 2004 elected directly
by the people. From the results of this study concluded that there are there principal. The
First, background applied to the election of Governor and Deputy Governor directly in Law
Number 32 year 2004 on Regional Goverment, philosophically motivation to carry out direct
elections is partly because an indirect mechanism of democracy does not guarantee
accommodation of in selecting candidates for leadership. Second, strengths and weaknesses
of the election of Governor and Deputy Governor directly in Law Number 32 Year 2004 on
Regional Government, the advantage gained is direct local elections is an opportunity for the
political education of the people, system of check and balances betwen the legislative and
executive branches can be more in balance, as a means to strengthen regional autonomy. As
for the expense of funds needed in the election of Governor and Deputy Governor of
relatively higher,opens up to the possibility of conflict and the elite, people activities
impaired especially during campaigns.

Adapun latar belakang diterapakannya pemilihan Gubernur dan Wakil Gubernur secara
langsung oleh rakyat dapat ditinjau secara filosofis, sosiologis dan yuridis. Pertama, secara
filosofis kita bisa melihat bahwa Dorongan untuk melaksanakan pemilihan kepala daerah
secara langsung ini antar lain karena mekanisme demokrasi secara tidak langsung belum
menjamin terakomodasinya aspirasi rakyat dalam memilih calon pemimpinnya. Kedua,
secara sosiologis pemilihan Kepala Daerah dalam hal ini Gubernur dan Wakli Gubernur
secara langsung oleh rakyat merupakan perwujudan pengembalian “hak-hak dasar” rakyat
dalam memilih pemimpin didaerah. Ketiga, pemilukada secara langsung sesungguhnya sudah
diintrodusir dalam produk hukum yang mengatur pemerintahan didaerah jauh sebelum
pembentukan Undang-Undang Nomor 32 Tahun 2004 dan Undang-Undang Nomor 22 Tahun
2007.
