KEPENTINGAN INDONESIA TIDAK MERATIFIKASI ASEAN AGREEMENT ON TRANSBOUNDARY HAZE POLLUTION (AATHP) TAHUN 2002-2012

Abstract

This research to describes the interests of Indonesia has not ratified the ASEAN Agreement On Transboundary Haze Pollution (AATHP) from start AATHP signed by Indonesia in 2002 until 2012. The purpose of this research is to analyze the existence of interests and other factors that cause AATHP Indonesia has not ratified until today. Indonesia is a country that has a forest area in large numbers in the region of Southeast Asia. The size of the forest area has implications for forest fires. Forest fires are frequent disasters in Indonesia, forest fires are very bad impact and a great loss for Indonesia, especially forest fires in 1997 and 2006. In addition it also fires cause smog and cause air pollution. The smog is not just the territory of Indonesia region only but other countries have entered the region, the influx of smog in the country known for its transboundary haze pollution. To address transboundary haze disaster some ASEAN countries agreed to establish an agreement manuscript known as the ASEAN Agreement on Transboundary haze pollution (AATHP). This agreement was signed in Kuala Lumpur in 2002 and entered into force in 2003. Of all the ASEAN member countries only Indonesia has not ratified the treaty to date. The research shows causes of Indonesia did not ratify AATHP is, the constraints of the legislature and the executive, and the law interest and economic interests which become a big consideration for Indonesia to ratify the treaty.
