Perlindungan Hukum Terhadap Perempuan Korban Kekerasan Dalam Rumah Tangga (Kdrt) Berdasarkan Cedaw Di Indonesia

Abstract

Elimination of Domestic Violence Law (Law No.23/2004 or UUPKDRT) is government policy to protect human rights especially woman’s human rights. This paper examines whether the rights of woman victims of domestic violence in Indonesia based on principles of Convention on the Elimination of All Forms of Discrimination Againts Women (CEDAW). This research is normative legal one and uses secondary data. The conclusion is Elimination of Domestic Violence Law (UUPKDRT) has applied principles of CEDAW. In this paper, writer recommends to build special court to face cases of domestic violence. This court should use mediation method and has ad hoc judges who have skill in criminal action especially domestic violence.
