Abstract

Indonesian nation made up of many diverse tribes and cultures, each tribe has a different pattern. Difference is costums in every also occur the common law. The coused of common law make up rule of life in the community and applicable formed habits to the Indonesian people. Diversity of common law could be seen in the community of Minangkabau. One of the factors causing the difference is the way of interesting lineage. The lineage could be cousing different of the common marriage law and the heritage. Marriage is very important in period of life. Because the community of Minangkabau is the matrilineal, its mean while a person who did the marriage must be with different tribe and they are not permitted to marry in the same tribe, because the people who in the same tribe are considered brothers or sisters. This is where the costumary punishment imposed. Therefore, mating with the same rate in Minangkabau society is prohibited.
